1. Acceptance of Terms

By using the sceneview-mcp server ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

sceneview-mcp is a Model Context Protocol (MCP) server that provides AI assistants with code generation guidance, code validation, and SDK reference documentation for the SceneView 3D/AR library.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Thomas Gorisse makes no warranty that:

The Service will meet your requirements
The Service will be uninterrupted, timely, secure, or error-free
The results obtained from the Service will be accurate or reliable
Generated code will be free of bugs, vulnerabilities, or errors
The Service will be compatible with any specific platform, device, or software version

4. Generated Code

All code generated or suggested by this Service is provided for informational and educational purposes only. You are solely responsible for:

Reviewing all generated code before use
Testing generated code in your own environment
Ensuring generated code meets your security, performance, and quality requirements
Any consequences of deploying generated code in production

Generated code is not a substitute for professional software engineering review.

5. Limitation of Liability

IN NO EVENT SHALL THOMAS GORISSE, SCENEVIEW, OR ANY CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING BUT NOT LIMITED TO PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOSS OF USE, DATA, OR PROFITS, OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

Maximum liability: In no event shall the total aggregate liability exceed the amount paid by you to Thomas Gorisse for the Service in the twelve (12) months preceding the claim, or EUR 0 (zero) if no payment was made.

6. Not Professional Advice

This Service does not constitute professional advice of any kind, including but not limited to legal, tax, financial, architectural, or engineering advice. Always consult qualified professionals for such matters.

7. User Responsibility

You agree that:

You will review all generated code before deploying to production
You will not rely solely on the Service for critical or safety-sensitive applications
You are responsible for compliance with applicable laws and regulations
You will not use the Service for unlawful purposes

8. Intellectual Property

The Service is licensed under the MIT License
Generated code output is provided without claim of ownership — you may use it freely
SceneView SDK and its documentation remain under their respective licenses

9. Paid Subscriptions (Pro Tier)

The Service offers a free tier and a paid "Pro" subscription tier:

Free tier: 15 core tools (learning, validation, setup, guides) are available at no cost.
Pro tier (€9.99/month): Unlocks 36+ additional tools including multi-platform setup, scene generation, 3D artifacts, and specialized packages (Automotive, Gaming, Healthcare, Interior).

Pro subscriptions are billed through Stripe via Polar.sh. By subscribing, you agree to:

Recurring monthly billing until cancelled
Cancellation takes effect at the end of the current billing period
No refunds for partial months
Pro features become inaccessible once the subscription lapses

API keys are validated against your active Stripe subscription. Sharing API keys is prohibited.

10. Service Availability

Thomas Gorisse reserves the right to:

Modify, suspend, or discontinue the Service at any time without notice
Update these Terms at any time; continued use constitutes acceptance
Limit or restrict access to the Service at any time

11. Data and Privacy

See PRIVACY.md for our privacy policy. In summary: for free-tier users, we collect no personal data. For Pro subscribers, we process only the data necessary for billing (see PRIVACY.md for details).

12. Governing Law

These Terms are governed by the laws of France. Any disputes shall be subject to the exclusive jurisdiction of the courts of Nantes, France (Tribunal judiciaire de Nantes).

For free-tier users, the Service does not process personal data. For Pro subscribers, billing data (email, payment method) is processed by Stripe and Polar.sh under their respective privacy policies. API key validation is cached in-memory for 5 minutes and not persisted.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
